The Platform is operated by Exclusif Corporation, doing business as EXC Luxury (“EXC,” “EXC Luxury,” “we,” “us,” or “our”).
By creating an account, accessing the Platform, or booking, offering, or providing services through EXC, you agree to these Terms.
1. EXC Luxury is a Technology Marketplace
EXC operates a technology marketplace designed to connect individuals seeking beauty and personal-care services (“Customers”) with independent beauty professionals (“Stylists” or “Providers”).
Unless expressly stated otherwise, EXC does not itself perform cosmetology, beauty, barbering, nail, esthetic, or other professional services.
Services booked through the Platform are performed by independent Providers.
EXC may facilitate discovery, matching, scheduling, communications, payments, reviews, credential verification, and other marketplace functionality.
2. Eligibility
Users must be at least 18 years old and legally capable of entering into a binding agreement to create an independent EXC account.
Users agree to provide accurate, current, and complete information.
3. Customer Responsibilities
Customers are responsible for:
- Providing accurate account, booking, location, and event information
- Maintaining account security
- Providing a safe and reasonably accessible service location
- Being available at the scheduled appointment time
- Communicating relevant service information to the Provider
- Treating Providers professionally and respectfully
- Paying applicable charges.
Customers may not use the Platform for fraudulent, illegal, abusive, discriminatory, threatening, or unsafe purposes.
4. Stylist Requirements
Stylists represent and warrant that they:
- Possess all licenses, registrations, certifications, permits, insurance, and qualifications required for services they offer
- Will maintain required credentials
- Will perform only services they are legally authorized and professionally qualified to perform
- Will comply with applicable Florida law, professional regulations, sanitation requirements, and local requirements
- Will provide accurate professional information
- Will comply with applicable tax and business obligations
- Will notify EXC of any suspension, restriction, expiration, or revocation of applicable professional credentials.
EXC may verify credentials and may restrict access when credentials cannot be verified.
Verification does not constitute a guarantee of a Provider's performance or continued eligibility.
5. Location of Services
Certain cosmetology or specialty services are subject to restrictions concerning where those services may legally be performed.
EXC may limit the availability of services based on:
- Service type
- Provider credentials
- Service location
- Customer-provided information
- Special Event information
- Applicable law.
Availability through the Platform does not override professional licensing or location requirements.
6. Standard On-location Services
EXC may permit on-location services that applicable Florida law allows to be performed outside a licensed salon by a properly licensed professional.
Service availability may be modified based on applicable legal or regulatory requirements.
7. Special Event Services
Florida law may permit cosmetology or specialty services to be performed outside a licensed salon when the service is performed in connection with a qualifying Special Event and by a person holding the proper license or specialty registration.
EXC may therefore offer a Special Event booking pathway.
For purposes of determining booking eligibility, EXC may request information regarding whether the appointment is connected with an organized public or private event meeting applicable Florida requirements.
Special Event eligibility is subject to applicable Florida law and regulations.
7.1 Event Duration
A Special Event booking must relate to an event lasting no more than three consecutive days.
Special Event services cannot be booked for events lasting more than three consecutive days.
EXC may prevent completion of a Special Event booking when the dates entered indicate that the event exceeds the permitted duration.
7.2 Connection Between the Service and Event
The requested cosmetology or specialty service must be genuinely connected with the identified Special Event and must satisfy applicable Florida requirements concerning the relationship between the service and the event.
EXC may request that Customers explain how the requested beauty service relates to or is essential to their participation in the event.
Merely identifying an event does not automatically establish eligibility for the Special Event booking pathway.
7.3 No Services to the General Public
A Special Event booking may not be used to arrange cosmetology services offered generally to members of the public.
Services must be associated with the identified Customer or other identified participants connected with the event, consistent with applicable law.
7.4 Special Event Information
Customers may be required to provide:
- Event type
- Event name or description
- Event start and end dates
- Event location
- Customer's role in the event
- Explanation of how the requested service is connected with or essential to the event
- Identification of whether services will be provided only to persons associated with the event
- Other information reasonably necessary for booking or compliance purposes.
Potential event categories presented by EXC may include weddings, fashion events, corporate events, conferences, galas, celebrations, graduations, professional presentations, and other organized events.
Displaying an event category within the Platform does not constitute a representation by EXC that every event within that category automatically qualifies as a Special Event under Florida law.
8. Customer Special Event Certification
Before completing a Special Event booking, the Customer may be required to certify:
“I certify that the information provided about this event is true and accurate and that the requested beauty service is being booked in connection with the event identified above. I understand that the event must meet applicable Florida requirements for Special Event services and that selecting the Special Event option does not by itself establish eligibility.”
Customers may not falsely characterize an ordinary appointment as a Special Event for the purpose of obtaining services at a location where those services would otherwise not be legally permitted.
Materially inaccurate or fraudulent information may result in:
- Booking cancellation
- Refund limitations where permitted by law and applicable policy
- Account review
- Account restriction
- Account suspension or termination.
9. Provider Review of Special Event Bookings
The Provider remains responsible for determining whether the Provider is appropriately licensed or registered to perform the requested service.
Providers may receive relevant Special Event information submitted by Customers.
A Provider may decline or cancel a booking if the Provider reasonably determines that:
- The Provider lacks the required credential
- The requested service cannot legally be performed at the requested location
- Special Event requirements do not appear to be satisfied
- Customer information is materially inconsistent or incomplete
- Performing the service would violate professional, sanitation, safety, or legal requirements.
EXC's acceptance or transmission of a booking does not constitute legal advice or a guarantee that a particular service may legally be performed at a particular location.
10. Special Event Records
EXC may retain information relating to Special Event appointments, including:
- Customer identity
- Provider identity
- Provider license or registration information
- Service requested
- Appointment date and time
- Service location
- Event type
- Event dates
- Customer role
- Customer explanation of the relationship between the service and event
- Customer certification
- Booking status
- Related transaction information.
EXC may use such records for compliance, safety, fraud prevention, dispute resolution, regulatory inquiries, and other lawful business purposes.
11. Bookings
All bookings remain subject to:
- Provider availability
- Geographic coverage
- Service eligibility
- Professional licensing requirements
- Payment authorization
- Applicable travel restrictions
- Special Event requirements, when applicable
- EXC policies.
EXC does not guarantee that a particular Provider will accept or complete a requested appointment.
12. Pricing and Fees
The Platform may display charges including:
- Service price
- Platform or service fee
- Travel fee
- Taxes
- Additional approved charges
- Other disclosed fees.
Customers authorize EXC and its payment-processing partners to charge the selected payment method for applicable amounts.
Tips are voluntary unless expressly disclosed otherwise.
13. Travel Fees
Additional travel fees may apply based on distance, service area, appointment location, Provider location, or other disclosed marketplace rules.
Applicable travel charges should be presented before booking confirmation whenever practicable.
14. Cancellations, No-shows and Refunds
Bookings are subject to EXC's applicable Cancellation and Refund Policy.
Cancellation fees may apply depending on timing and circumstances.
A Customer unavailable at the scheduled service location may be considered a no-show.
Providers who repeatedly cancel confirmed appointments without reasonable cause may be subject to account restrictions.
15. Memberships, Rewards and Promotions
EXC may offer memberships, loyalty programs, points, promotional credits, discounts, gift cards, or other benefits.
Specific program terms will govern those programs.
Unless otherwise stated:
- Membership fees do not include underlying beauty services
- Membership benefits have no cash value
- Rewards or promotional credits are not cash
- Fraudulent or abusive use may result in cancellation or restriction.
16. Stylist Payments
EXC may collect Customer payments and facilitate Provider payouts through third-party payment processors.
EXC may deduct applicable commissions, platform charges, refunds, chargebacks, adjustments, or other authorized amounts.
Additional compensation terms may be governed by a separate Stylist Agreement.
17. Independent Provider Relationship
Unless expressly provided otherwise in a written agreement, Providers operate as independent service providers and not as employees of EXC.
Providers control the professional manner and means of performing their services, subject to applicable law, professional standards, marketplace requirements, and their commitments to Customers.
The legal classification of Providers is determined under applicable law and the actual relationship between the parties.
18. Customer and Stylist Safety
EXC prohibits:
- Harassment
- Threats or violence
- Sexual misconduct
- Unlawful discrimination
- Fraud
- Theft
- Unsafe conduct
- Illegal activities
- Material violations of professional health or sanitation requirements.
Users should contact emergency services directly in an emergency.
19. Background, Identity and Credential Checks
EXC may use third parties to perform identity verification, KYC, professional credential verification, and, where legally permitted, background screening.
Verification does not constitute a guarantee regarding a Provider's conduct, qualifications, safety, reliability, or future behavior.
20. Ratings and Reviews
Reviews must reflect genuine experiences and may not contain fraudulent, defamatory, discriminatory, threatening, unlawful, or prohibited content.
EXC may moderate or remove content that violates applicable policies or law.
21. User Content
Users may submit photographs, videos, reviews, portfolio materials, profiles, and other content.
Users retain ownership of original content but grant EXC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute such content as reasonably necessary to operate and promote the Platform and the user's participation in it.
22. Prohibited Use
Users may not:
- Create fraudulent accounts
- Misrepresent identity or professional qualifications
- Provide false Special Event information
- Circumvent Platform fees or payment systems in violation of applicable agreements
- Engage in fraudulent transactions
- Interfere with Platform security
- Introduce malicious software
- Harass users
- Use the Platform for illegal activities
- Violate applicable professional requirements.
23. Platform Availability
EXC does not guarantee uninterrupted operation of the Platform.
Availability may be affected by maintenance, technical failures, third-party systems, cybersecurity events, upgrades, or circumstances beyond EXC's reasonable control.
24. Third-party Services
EXC may rely on third parties for payment processing, cloud hosting, mapping, identity verification, messaging, analytics, background screening, and other functions.
25. Professional Services Disclaimer
Beauty and personal-care services are performed by independent Providers and may involve risks, including allergic reactions, irritation, hair or nail damage, personal injury, dissatisfaction with results, or other adverse outcomes.
Customers are responsible for communicating relevant allergies, sensitivities, conditions, and product concerns directly to their Provider.
EXC does not provide medical advice.
26. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
EXC DISCLAIMS WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED.
EXC DOES NOT GUARANTEE THE QUALITY, SAFETY, LEGALITY, SUITABILITY, CONDUCT, OR RESULTS OF SERVICES PROVIDED BY INDEPENDENT PROVIDERS.
Nothing in these Terms excludes rights that cannot legally be excluded.
27. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE PLATFORM.
Nothing limits liability that cannot lawfully be limited or excluded.
28. Indemnification
To the extent permitted by law, users agree to indemnify and hold harmless EXC and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from the user's:
- Violation of these Terms
- Violation of applicable law
- Misuse of the Platform
- Materially false booking or Special Event information
- Infringement of third-party rights

29. Account Suspension and Termination

32. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law controls.
33. Dispute Resolution
Before initiating formal legal proceedings, users and EXC are encouraged to attempt in good faith to resolve disputes directly with EXC.
Any arbitration provision, class-action waiver, jury-trial waiver, venue requirement, and associated opt-out procedure should be separately reviewed and approved by EXC's Florida legal counsel before implementation.
34. Changes to These Terms
EXC may modify these Terms prospectively.
Material changes may be communicated through the Platform, email, or other appropriate means.
Where required, users may be required to affirmatively accept updated Terms.
35. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.
36. Entire Agreement
These Terms, the Privacy Policy, and additional policies or agreements incorporated by reference constitute the applicable agreement regarding use of the Platform.
Separate agreements may govern Providers, memberships, promotions, or other EXC programs.
